Homeowners to appeal Long Branch eminent domain decision: (South Jersey) Courier-Post, 6/23/06

Oceanfront homeowners plan to appeal a ruling that allows Long Branch to condemn their properties in favor of a condominium development.

The ruling Thursday by a state judge in Freehold came as the state Assembly passed a bill that would limit how governments can take private land for development. No similar legislation has been advanced by the state Senate.

Long Branch sought to condemn 24 properties so it could redevelop a portion of its beachfront. The redevelopment plan was adopted in 1996, but homeowners said they now object because the plan shifted against small homes in 2002, something Long Branch Mayor Adam Schneider denied.
